§ 1. Conclusion of Contract

2. The presentation of goods on our website www.hintermann-shop.com is only a non-binding invitation for customers to order our items and does not constitute a legally binding offer.
3. By placing a written order for the goods, the buyer makes a binding offer to conclude a purchase contract. The acceptance of this offer will be confirmed to the customer by email or in writing.
4. The customer submits a binding offer by successfully completing the following ordering process, which is intended for our website.

§ 2. Cross-border Orders within the EU

1. These General Terms and Conditions apply to all orders and deliveries made within the EU.

2. For cross-border orders and deliveries, German law applies.
§ 3. Shipping / Delivery
​
1. The goods are delivered by a shipping service provider selected by us. All prices listed on our website are exclusive of shipping fees.
2. Delivery generally takes place within 14 days after receipt of payment. For smaller orders/quantities, the goods will be shipped significantly earlier. For bulk orders of Pompfen, delivery may take up to 60 days. Depending on the order volume, shipping may be delayed by up to 6 months.
3. If the delivery is delayed, the buyer may withdraw from the contract only after setting a reasonable deadline in writing and allowing a grace period.
4. All items offered are manufactured only after the order is placed unless otherwise noted in the product description.
5. Claims for damages are excluded unless liability is mandatory under statutory provisions.

§ 4. Retention of Title
We retain ownership of the goods until full payment of the purchase price has been received.

§ 5. Cancellation
​
​In the case of multiple deliveries, the buyer bears the costs. A cancellation of the order is always free of charge if the delivery deadline or the subsequently exceeded grace period has passed without the goods being delivered.

§ 6. Payment
​
1. Payment is made exclusively in advance. For this purpose, the buyer will receive an order confirmation (offer) in writing after their order has been received, along with payment instructions or information.
2. Payment in advance is only considered made once the full amount has been transferred to the specified account, and we have full access to the amount.
3. An offer received from us is valid for 14 days. If no payment is received after this period, we will assume that you no longer require the goods, and the order will be canceled.
4. All prices listed on the website do not include statutory VAT. Only the shipping costs are added.

§ 7. Right of Withdrawal
​
1. You have the right to withdraw from this contract in writing within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day you or a third party named by you (excluding the carrier) has taken possession of the items.
2. Contracts in which the goods are manufactured, altered, or printed at the written request of the buyer are excluded from the right of withdrawal. The statutory warranty rights remain unaffected.
3. If the withdrawal is justified, we will refund the purchase price already paid within 30 days.
4. The return shipping costs are borne by the buyer.
5. The withdrawal/return of the goods must be made to the following address:

6. If the customer receives the cancellation policy only after delivery of the goods, the withdrawal period will begin only upon receipt of the cancellation policy.
7. To comply with the withdrawal period, it is sufficient to send the written notice of withdrawal or return the goods before the expiration of the 14-day period. The period is observed if you send the goods to be returned before the 14 days expire.

§ 8. Complaints about Defects
​
​The buyer is obliged to inspect the delivered goods immediately upon receipt and to report any complaints in writing within 10 days. After this period, the warranty for visible defects expires. If the goods are defective and the complaint is timely, we are obliged to provide a replacement or reimburse the reduced value. Claims for cancellation or damages, especially for consequential damages, are excluded.

§ 9. Disclaimer of Liability
​
1. Pompfen are sports equipment and are not designed to be used with maximum force.
2. We accept no liability for any damage caused by improper use.
